Terms of Service

These Terms of Service ("Terms") govern your use of CoachMoach ("Service"), operated by CoachMoach (see Imprint for full legal entity details).

By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

You must be at least 18 years old to use CoachMoach. If you are between 16 and 18, you may use the Service only with verifiable parental or guardian consent and only where this is permitted by applicable law. By creating an account you represent that you meet this age requirement.

You must not use the Service if you have a medical condition for which unsupervised exercise is contraindicated, unless your physician has explicitly approved such activity. CoachMoach cannot verify your health status. You are responsible for assessing whether any exercise, plan, weight, repetition target, or intensity recommendation is suitable for you.

CoachMoach is an AI-powered fitness coaching application that provides:

• Workout tracking and exercise logging
• AI-generated coaching cues and motivational guidance delivered via voice and text
• Voice interaction using your device microphone (see Section 7)
• AI-generated workout plans (see Section 8)
• Background music adapted to workout phases via third-party streaming
• Optional exercise demonstration videos from third-party platforms such as YouTube
• Progress statistics, streaks, and achievements

The Service is provided as a consumer fitness tool. It is not a substitute for a certified personal trainer, physiotherapist, or any other health professional.

Before beginning any exercise program, consult your physician or a qualified healthcare provider, particularly if you:

• Have a known cardiovascular, respiratory, or musculoskeletal condition
• Are pregnant or postpartum
• Have not exercised regularly in the past 6 months
• Are recovering from an injury or surgery

Exercise results vary between individuals. CoachMoach makes no guarantees regarding fitness outcomes, weight loss, muscle gain, injury prevention, or any other health metric. All content is for general fitness education only.

You are responsible for checking your training environment and equipment before exercising. Use spotters or suitable safety equipment for heavy or risky lifts, and reduce or stop an exercise if a recommendation feels unsafe, painful, or beyond your current ability.

Emergency: Do not use CoachMoach in medical emergencies. If you believe you are experiencing a medical emergency, stop exercising immediately and call your local emergency number.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Registration may take place by email/password or a supported third-party login provider such as Google through Supabase Auth. A contract for use of the free Service is formed when your account is created and you accept these Terms. For paid subscriptions, Section 11 applies.

Each person may hold one account. Creating multiple accounts to circumvent restrictions or abuse free tiers is prohibited. We reserve the right to merge or delete duplicate accounts.

You must notify us immediately at legal@coachmoach.com if you suspect unauthorised access to your account.

You retain ownership of all workout data, exercise logs, and personal records you enter into the Service. By using the Service, you grant CoachMoach a limited, non-exclusive, royalty-free licence to store, process, and display that data solely for the purpose of operating and improving the Service for you.

We do not sell your personal workout data to third parties. Aggregated, anonymised statistical data (e.g. most popular exercises) may be used internally.

The AI voice coaching feature requires access to your device microphone. By enabling voice features, you consent to the following data processing:

• Local VAD processing: Voice Activity Detection runs entirely in your browser. No audio data leaves your device at this stage.
• Local Whisper speech-to-text: When voice activity is detected, short audio segments are transcribed in your browser using an in-browser Whisper model. Model files may be downloaded from Hugging Face or served from CoachMoach, but your microphone audio is not sent to Hugging Face or OpenAI for transcription in the current implementation.
• No permanent storage: Audio recordings are not stored beyond the active session. Only the resulting text transcript may be retained as part of session context.
• Text-to-speech: Text selected for spoken coach cues may be sent to Inworld AI to generate synthetic voice output. This is text only, not your microphone audio.

Voice features are entirely optional. You can use CoachMoach in manual mode without granting microphone access. You can withdraw microphone permission at any time via your browser or device settings.

Coaching cues, workout plans, motivational messages, summaries, and chat responses may be generated by artificial intelligence, including OpenAI models. This content:

• Is not reviewed or approved by certified personal trainers before delivery
• May occasionally be inaccurate, incomplete, or inappropriate for your specific condition
• May not reflect the latest sports science or medical guidance
• Should not be followed without applying your own judgment and physical awareness

You are solely responsible for how you execute exercises. Stop immediately if you feel pain, dizziness, or discomfort — regardless of what the AI coach suggests.

CoachMoach and all associated branding, software, design, system workout templates, and documentation are the intellectual property of CoachMoach and its licensors. Nothing in these Terms grants you any right to use CoachMoach's name, trademarks, or proprietary materials.

The workout templates provided by CoachMoach as part of the Service are licensed for personal, non-commercial use only. Copying, redistributing, or sublicensing these templates is prohibited.

Your privacy matters. Our full Privacy Policy explains in detail how we collect, use, and protect your personal data in compliance with the EU General Data Protection Regulation (GDPR).

Key points:

• Health and fitness data is special category data under GDPR Article 9. We process it only with your explicit consent, which you provide by creating an account and using health or fitness tracking features.
• Your GDPR rights: You have the right to access, rectify, erase, port, and object to processing of your personal data at any time.
• Third-party processors: OpenAI (US), Supabase (EU/US), Jamendo (EU), and Inworld AI (US) are used for core AI, authentication, storage, music, and voice features. Depending on the enabled feature set, CoachMoach also uses Vercel (hosting), Upstash (rate limiting), Lemon Squeezy (billing), Hugging Face (model downloads), and Google/YouTube (OAuth, video search, embedded videos, and optional calendar export). International transfers are protected by GDPR Chapter V safeguards such as EU Standard Contractual Clauses where required.

CoachMoach offers a free tier and may offer paid premium subscriptions. Paid subscriptions are processed by Lemon Squeezy or another payment provider shown at checkout.

• Pricing, included features, trial terms, taxes, billing cycles, and renewal terms are shown before purchase
• Subscriptions renew automatically unless cancelled through the billing portal or the payment provider's cancellation flow before the end of the current billing period
• After cancellation, premium access normally remains available until the end of the paid period unless stated otherwise at checkout
• EU consumers generally have a 14-day right of withdrawal for distance contracts. For digital services or digital content, this right may expire early if you expressly consent to immediate performance and acknowledge that you lose the withdrawal right once performance begins, where permitted by law
• Refunds, chargebacks, invoice corrections, and payment disputes are handled under applicable consumer law and the payment provider's process

You are responsible for keeping billing information current. If payment fails, premium access may be suspended or downgraded after reasonable retry and notice where practicable.

To exercise a statutory withdrawal right, contact legal@coachmoach.com with a clear statement that you withdraw from the paid contract, including the email address used for the purchase and the purchase date if available.

You agree not to:

• Circumvent, disable, or otherwise interfere with security or authentication features
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use automated tools (bots, scrapers) to access or collect data from the Service
• Abuse AI, voice, music, billing, or rate-limited features, including by attempting to bypass usage limits
• Upload, submit, or request unlawful, infringing, abusive, or unsafe content
• Use the Service for any commercial purpose without our prior written permission
• Attempt to access accounts, data, or systems belonging to other users
• Violate any applicable law or regulation

Violation of these terms may result in immediate account suspension or termination, at our discretion.

CoachMoach is liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and where liability cannot be excluded or limited under applicable law.

For paid services, CoachMoach is liable for slight negligence only if an essential contractual obligation is breached. In that case, liability is limited to the typical, foreseeable damage. Essential contractual obligations are obligations whose fulfilment enables proper performance of the contract and on whose compliance you may regularly rely.

For free services, CoachMoach is liable only for intent, gross negligence, and the legally mandatory cases listed above. Otherwise, liability is excluded to the extent permitted by law.

The above limitations also apply to the personal liability of CoachMoach's representatives, employees, contractors, and agents.

You may delete your account at any time from the Settings page or by contacting privacy@coachmoach.com. Upon deletion, your personal data will be erased in accordance with our Privacy Policy and GDPR Article 17 (right to erasure).

You may request a copy of your data (workout history, profile, session logs) before deletion in a machine-readable format under GDPR Article 20 (data portability).

CoachMoach may suspend or terminate your account if you materially breach these Terms, following reasonable notice where practicable. If we discontinue the Service, we will provide at least 30 days' advance notice and an opportunity to export your data, in compliance with the EU Data Act.

We may update these Terms from time to time. Material changes will be communicated to you at least 30 days in advance via email or an in-app notice, as required by the EU Digital Services Act. The updated Terms will show a revised "Last updated" date at the top of this page.

Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you do not accept the revised Terms, you may terminate your account before they take effect.

These Terms are governed by the laws of Germany, without regard to its conflict of law provisions.

If you are a consumer resident in the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence, which these Terms do not override.

We encourage you to contact us at legal@coachmoach.com before initiating any formal proceedings. We are not obligated to and do not participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).

Exclusive jurisdiction for any disputes not resolved amicably lies with the courts of Germany, subject to applicable EU consumer law rights.
